Terms of Service
Welcome to Nofacto. By using our services you accept these terms. Read them carefully. If you don't agree, don't use the platform.
1. What is Nofacto
Nofacto is a SaaS platform for laser cutting workshops in LATAM. It lets you generate automatic quotes, manage orders, and receive payments through a public quoter with your branding.
2. Your account
To use Nofacto you must create an account with a valid email and verify your WhatsApp number. You are responsible for the security of your password and any activity under your account. If you detect unauthorized use, notify us immediately at [email protected].
3. Plans and payments
We offer a permanent Free plan with a limit of 30 monthly quotes (combined: internal + public quoter). Pro and Ultra plans are monthly paid subscriptions processed by Paddle.com Market Ltd. as Merchant of Record. Prices are shown in USD or in your local currency depending on your location; Paddle calculates and collects the applicable taxes in your jurisdiction. You can cancel your subscription at any time from your billing panel — you keep access until the end of the paid period. For the refund policy see the Refunds page.
Payment processor — Merchant of Record
Nofacto uses Paddle.com Market Ltd. as Merchant of Record to process paid subscriptions. This means Paddle is the seller of record, bills the charge to your payment instrument, collects applicable taxes, and processes refunds on our behalf. By subscribing you also accept Paddle's Checkout Buyer Terms (paddle.com/legal/checkout-buyer-terms) and Privacy Policy (paddle.com/legal/privacy). If your subscription shows on your card statement, it will appear as a "Paddle" or "Paddle.net" charge.
4. Acceptable use
You agree not to use Nofacto for unlawful purposes, not to attempt to access other workshops' data, not to abuse the system with automated scripts or multiple accounts to bypass plan limits, and to respect third-party intellectual property rights.
5. Your content
Files you or your customers upload (DXF, SVG, PDF) are your property. Nofacto stores them only as long as needed to process the quote and order. You can delete them anytime from your panel.
6. Payments to your customers
It's important to distinguish two payment flows within Nofacto: (a) Your subscription to Nofacto is processed by Paddle as Merchant of Record (see Clause 3). (b) The payments you receive from your end customers through the public quoter are independent from Nofacto: when you configure a payment method (Bre-B, Pix, CoDi, Yape, Transferencias 3.0, SINPE, Pago Móvil or manual transfer), funds go directly to your bank account. Nofacto does not intermediate, hold or retain those funds. You are responsible for complying with your local tax obligations on the income you receive from your customers.
7. Availability and support
We do our best to keep Nofacto available 24/7, but we don't guarantee a specific service level. If there are issues, we'll notify you by email. Support is offered by email at [email protected] with response during business hours.
8. Cancellation and deletion
You can delete your account anytime from the settings panel. After deletion we keep your data for 30 days in case you decide to reactivate; after that it is permanently deleted.
9. Limitation of liability
Nofacto is offered "as-is". We are not liable for indirect damages, lost profits, data loss, or imprecise quotes due to incorrect calibration. Calibration is your responsibility — we provide the tools; we do not guarantee results without you verifying them.
10. Changes to these terms
We may update these terms. If changes are significant, we'll notify you by email 30 days in advance. If you continue using Nofacto after the change, you accept the new terms.
11. Governing law
These terms are governed by the laws of Colombia. Any dispute will be resolved in the courts of Bogotá, unless your country of residence's legislation provides otherwise for end consumers.
12. Service provider identification
Nofacto is operated by Jesús Daniel Sánchez Rueda, an individual sole trader (Persona Natural), holder of Colombian Tax ID 1.049.657.235-3, with registered address at Carrera 23 #10-16, Yopal, Casanare, Colombia. Contact: [email protected]. Paid subscriptions are billed and processed by Paddle.com Market Ltd. in its capacity as Merchant of Record (see Clause 3).
Annex I — Habeas Data (Colombia)
Under Colombia's Statutory Law 1581 of 2012 and Regulatory Decree 1377 of 2013, as Data Subject you have the right to access, update, rectify, and delete your personal data, and to revoke consent for its processing. Nofacto acts as Data Controller. Your data may be transferred to Firebase (Google Cloud) in the United States for storage and processing. To exercise your rights write to [email protected] — we respond within 15 business days. If unsatisfied, you may file a complaint with the Superintendence of Industry and Commerce (SIC).
